LOS ANGELES, Nov. 10, 2022 (GLOBE NEWSWIRE) — In a legal business dispute raging between the United States and Mexico, a U.S. District Court Judge Wednesday ruled that Mexican defendant Luis Barroso de la Ville Fuente and the rival company he created violate fiduciary duty owed to US partner Kolay Flooring International, LLC, based in City of Industry, and its owner, President and CEO Dan Mitchell I conspired to do that.

Meanwhile, in Mexico, Kolay and Mitchell filed a lawsuit against Barroso De La Fuente alleging unfair competition and illegally registering Kolay’s trademarks in their names without the permission of Mitchell or Kolay. Kolay’s Mexican attorney said Mitchell and Kolay could seek lost profits and damages after those issues are resolved. Also, Mitchell and Corey’s local partner are seeking criminal action and an injunction against Barroso de la Fuente for allegedly threatening Mitchell and his Corey partner.
The company Barroso De La Fuente and his father founded in Mexico was Pisos Kolay, SA de CV, which was renamed Lalur, SA de CV after Mitchell discovered Barroso De La Fuente’s wrongdoing. Despite the argument that the companies Barroso de la Fuente and Pisos Corei should be treated separately, U.S. District Judge Josephine Staton has ruled that Pisos Corei and Lalur are one and the same business entity. made a judgment.
Allegations in the U.S. lawsuit against Barosso de la Fuente and his company included, among other things, breaches of fiduciary duty and allegations of conspiracy to harm Corley.
