On 29 November 2022, the Public Information Access Authority (DPA) will incorporate an online registration form to allow foreign individuals and legal entities not established in Argentina but processing personal data of Argentine citizens to act as “Personal Database Responsible”. Personal Data Protection Act No. 25,326 and its related regulations stipulate that the person in charge of the database issuing the report (“database manager”) and the existence of said database must be registered in the National Register of Databases (“registry”).
Initially, the registration process had to be carried out in paper form and, in some cases, had to be renewed annually, but in 2018 the DPA decided by resolution 132/2018 that registration must be completed online. Did. Distant Tramites Platform (TAD).
However, TAD did not consider the scenario where the person in charge of the database is a foreigner, as well as the template registration form to fill out.
With the implementation of a new online registration form, foreign persons responsible for databases processing personal data of Argentine citizens must register with the Registry, even if they are not present in Argentina. The main objective of this initiative is to ensure a high level of protection for data subjects. This ensures that data subjects are not hindered from exercising their rights if the person responsible for the database is not located in Argentina.
